Pro Treat Inc. offers a 1 year limited warranty on our Pro Treat Xd and Xe products and 90 days for commercial use.

Limited Warranty

PRO TREAT INC. warrants Pro Treat Xd and Xe, against defects in material and workmanship for up to 1 (one) year from date of purchase and 90 days for comercial use. Under normal use and service, every hardware portion of the products will be free from physical defects in material and workmanship during the warranty period, or the product will be repaired or replaced as determined solely by PRO TREAT INC.. PRO TREAT INC. provides a limited warranty for its products only to the person or entity that originally purchased the product from PRO TREAT INC. or its authorized distributor or retailer.

The following standard warranty rules apply to PRO TREAT INC. products:

If a product does not operate as warranted above during the applicable warranty period, PRO TREAT INC. shall, at its option and expense (except for shipping cost), repair the defective product or part, deliver to the customer an equivalent product or part to replace the defective item. All products that are replaced will become the property of PRO TREAT INC.. Replacement products may be new or reconditioned.

Warranty does not apply, if:

  1. The warranty period is expired, 90 days for comercial use.
  2. The serial number label is broken or removed,
  3. The serial number label is missing or unrecognizable,
  4. The product has been modified or repaired by any unauthorized service center or personnel,
  5. The defect was subject to abuse, improper use not conforming to product manual instructions, or environment conditions more severe than those specified in the manual and specification.
  6. The defect was subject to Force Majeure, such as acts of God, flood, lighting, earthquake, war, vandalism, theft, over tightening of connection points – i.e. elbows, fittings, drain cap.
  7. Any failure caused by abuse, neglect, improper maintenance, unapproved modifications, use of unapproved add-on parts/modified parts or unapproved accessories.
  8. ALL CUSTOM ORDERED ITEMS OR BACPPACKS WITH LOGOS MAY NOT BE RETURNED OR EXCHANGED.

If the customer’s product is not covered under warranty, PRO TREAT INC. may offer Repair Services under the customer’s payment.

Unless other wise stated bellow Pro Treat Inc. offers a 1 year and/or 90 days for commercial use – limited warranty to the following product(s) – Pro Treat Xd and Xe are comprised of the following systems:

Container – Backpack, harness, straps and fasteners.

Pro Treat Inc. offersand/or 90 days for commercial use and no warranty for over tightening of drain cap, bolts, screws, seals and gaskets. Contact Pro Treat Inc. to purchase replacement parts or for service.

Power System – Battery, connectors, plugs.

  1. Pro Treat Inc. warrants only to the original user that all PRO TREAT INC. batteries will be free of defects in material and workmanship for a period of twelve (12) months from the date the battery is shipped from PRO TREAT INC. or 90 days for commercial use. We will at our option make any necessary repairs and/or exchange the defective battery F.O.B. without charge. Charges for correcting a defective battery will not be allowed nor will PRO TREAT INC. accept batteries returned for credit or exchange unless PRO TREAT INC. authorizes the correction or return in writing.
  2. All PRO TREAT INC. are warranted to be free of defects in materials and workmanship, and are manufactured in accordance with Pro Treat Inc.’s specification. Should a claim arise the following is our limited warranty policy:
  3. Conditions:
    1. A battery will not be considered defective unless it fails to deliver 60% of its original rated capacity during the warranty period.
    2. Each battery must be charged, discharged, stored and serviced in accordance with the manufacturers written instructions.
    3. PRO TREAT INC. is not responsible for batteries that fail due to improper charging or installation; broken container, or cover; damage caused by fire, excessive heat, wreckage, explosion or freezing; or damage caused by abuse or neglect; or any act of God.
  4. Return Policy:
    1. Upon satisfactory proof of claim as determined solely by PRO TREAT INC., we will:
    2. At our option either repair or replace the defective battery for a period of twelve (12) months or 90 days for commercial usefrom the date of original purchase.
    3. Not accept any product for return, credit, or exchange unless expressly authorized by PRO TREAT INC. in writing and returned freight prepaid to PRO TREAT INC.
  5. Pro Treat Inc. offers no warranty – for improper charging of battery, using another charger other then the one supplied with original purchase, damage as a result of altering battery, connectors, plugs. Contact Pro Treat Inc. to purchase replacement parts or for service.

Delivery System – Pump, hoses, fittings, nozzle.

  1. SHURflo Industrial series pumps and products are warranted to be free of defects in material and workmanship under normal use, for a period of one (1) year or 90 days for commercial use from the date of manufacture, or one (1) year or 90 days for commercial useof use, with proof of purchase.
  2. This limited warranty will not exceed one (1) year and/or 90 days for commercial use, in any event. The limited warranty will not apply to pumps/products that were improperly installed, misapplied, damaged, altered or are incompatible with fluids or components not manufactured by SHURflo.
    1. All Industrial pumps/products must be flushed of any chemicals before shipping*. All warranty considerations are governed by SHURflo’s written Return Policy.
    2. Returns are to be shipped postage prepaid to either service center; SHURflo’s office in Cypress, CA. SHURflo shall not be liable for freight dam-age incurred during shipping. Package returns carefully.
  3. SHURflo’s obligation under this warranty policy is limited to the repair or replacement of the pump/ product. All returns will be tested per SHURflo factory criteria. Products found not defective (under the terms of this limited warranty) are subject to charges paid by the returnee for the testing and packaging of “tested good” non-warranty returns.
  4. No credit or labor allowances will be given for pumps or products returned as defective. Warranty replacements will be shipped on a freight allowed basis. SHURflo reserves the right to choose the method of transportation.
  5. This limited warranty is in lieu of all other warranties, expressed or implied, and no other person is authorized to give any other warranty or assume obligation or liability on SHURflo’s behalf.
    1. SHURflo shall not be liable for any labor, damage or other expense, nor shall SHURflo be liable for any indirect, incidental or consequential damages of any kind incurred by the reason of the use or sale of any defective product or part. This limited warranty covers industrial products distributed within the United States of America. Other world market areas should consult with the actual distributor for any deviation from this document.
  6. Return Policy
    1. All Industrial pumps/products must be flushed of any chemical (ref. OSHA Section 1910.1200 (d)(e)(f)(g)(h)) and hazardous chemicals must be labeled / tagged before being shipped* to SHURflo for service or warranty consideration. SHURflo reserves the right to request a Material Safety Data Sheet from the returnee for any pump/product it deems necessary. SHURflo reserves the right to “disposition as scrap” pumps/products returned which contain unknown fluids. SHURflo reserves the right to charge the returnee for any and all costs incurred for chemical testing, and proper disposal of components containing unknown fluids. SHURflo requests this in order to protect the environment and personnel from the hazards of handling unknown fluids.
      1. *Carriers, including U.S.P.S., airlines, UPS, ground freight, etc., require specific identification of any hazardous materials to be shipped. Failure to do so may result in a substantial fine and/or prison term. Check with your shipping company for specific instructions.
  7. Pro Treat Inc. offers no warranty – for gaskets, seals, valves, check valves, pressure switches, as these items are typical wear items and are subject to maintenance. Contact Pro Treat Inc. to purchase replacement parts or for service.
  8. Repair Service
    1. Warranty and out of warranty service should be obtained by contacting Pro Treat Inc. where the customer purchased the product. When requesting for service, the proof of purchase and the product serial number must be provided. The return of the defective product should be strictly through the original route of purchase, and the customers shall pack the product appropriately to prevent the returned product from suffering in the transportation.
  9. There are user serviceable parts inside the product. Do not allow any unauthorized service center or personnel to repair or modify the product.

Pro Treat Xd or Xe backpack on-line at www.protreatinc.com/registermybackpack Registering your product confirms your warranty coverage and provides an directly if we need to find it necessary to contact you.

The owner shall demonstrate reasonable care and use, and follow preventative maintenance, storage, battery and maintenance, charging procedures an usage as prescribed in the operators manual.

Return Policy

ALL CUSTOM ORDERED ITEMS OR BACPPACKS WITH LOGOS MAY NOT BE RETURNED OR EXCHANGED ALL SALES ARE FINAL.

Unopened and unused backpacks in new condition and returned within 30 days we’ll receive a refund. Pro Treat Inc. reserves the right to charge a 15% restocking fee for any opened unused backpack. There is no “cooling off” period once the backpack is used there are no refunds. This is in part due to the intended use of the backpack. Once a backpack is used and any pesticide has passed through its systems this backpack can no longer be sold to another purchaser. Pro Treat Inc. is not responsible for cost of shipping for returns/exchanges unless prior written consent by Pro Treat Inc. is provided. Keep all original shipping and packaging products in the event of any/all returns.

DISCLAIMER OF WARRANTY

WARRANTIES EXCLUSIVE

IF THE PRO TREAT INC. PRODUCT DOES NOT OPERATE AS WARRANTED ABOVE, THE CUSTOMER’S SOLE REMEDY SHALL BE, AT PRO TREAT INC.’S OPTION, REPAIR OR REPLACEMENT. THE FOREGOING WARRANTIES AND REMEDIES ARE EXCLUSIVE AND ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, EITHER IN FACT OR BY OPERATION OF LAW, STATUTORY OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. PRO TREAT INC. NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT ANY OTHER LIABILITY IN CONNECTION WITH THE SALE, INSTALLATION MAINTENANCE OR USE OF PRO TREAT INC.’S PRODUCTS.

PRO TREAT INC. SHALL NOT BE LIABLE UNDER THIS WARRANTY IF ITS TESTING AND EXAMINATION DISCLOSE THAT THE ALLEGED DEFECT IN THE PRODUCT DOES NOT EXIST OR WAS CAUSED BY CUSTOMER’S OR ANY THIRD PERSON’S MISUSE, NEGLECT, IMPROPER INSTALLATION OR TESTING, UNAUTHORIZED ATTEMPTS TO REPAIR OR MODIFY, OR ANY OTHER CAUSE BEYOND THE RANGE OF THE INTENDED USE, OR BY ACCIDENT, FIRE, LIGHTNING, OR OTHER HAZARD.

LIMITATIONS OF LIABILITY

UNDER NO CIRCUMSTANCES WILL PRO TREAT INC., ITS SERVICE PROVIDER OR EITHER’S AFFILIATES, EMPLOYEES, OFFICERS, DIRECTORS OR AGENTS BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL, PUNITIVE, OR INCIDENTAL DAMAGES, WHETHER FORESEEABLE OR UNFORESEEABLE, (INCLUDING, BUT NOT LIMITED TO), CLAIMS FOR: LOSS OF GOODWILL, INCONVENIENCE, DELAY, PROFITS, USE OF MONEY OR USE OF THE PRO TREAT INC. PRODUCTS, INTERRUPTION IN USE OR AVAILABILITY OF PRODUCT(S).

PRO TREAT INC.’S AND THE SERVICE PROVIDER’S ENTIRE LIABILITY AND CUSTOMER’S SOLE AND EXCLUSIVE REMEDY FOR CLAIMS RELATED TO OR ARISING OUT OF THESE TERMS AND CONDITIONS FOR ANY CAUSE AND DESPITE THE FORM OF ACTION, WHETHER IN CONTRACT OR IN TORT, STATUTORY OR OTHERWISE, INCLUDING NEGLIGENCE AND STRICT LIABILITY, WILL NOT EXCEED THE AMOUNT OF THE PURCHASE PRICE PAID. THIS LIMITATION OF LIABILITY WILL BE EFFECTIVE EVEN IF CUSTOMER HAS ADVISED PRO TREAT INC. OR ITS SERVICE PROVIDER OF THE POSSIBILITY OF ANY SUCH DAMAGES.

THESE TERMS AND CONDITIONS GIVES CUSTOMER SPECIFIC LEGAL RIGHTS. CUSTOMER MAY ALSO HAVE OTHER RIGHTS THAT MAY VARY FROM STATE TO STATE OR FROM COUNTRY TO COUNTRY. CUSTOMER IS ADVISED TO CONSULT APPLICABLE STATE OR COUNTRY LAWS FOR A FULL DETERMINATION OF CUSTOMER’S RIGHTS. SOME STATES OR COUNTRIES DO NOT ALLOW A LIMITATION ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR CONSUMER PRODUCTS. IN SUCH STATES OR COUNTRIES, SOME EXCLUSIONS OR LIMITATIONS OF THESE TERMS AND CONDITIONS MAY NOT APPLY TO CUSTOMER.
